Terms of Service

Last updated 8 October 2026

These terms apply to everyone who uses UpHai: the website at uphai.in, the dashboard at app.uphai.in, status pages we host, and the free "Is it down in India?" checker. UpHai is run by its founder as a sole proprietorship in India. By creating an account or using the service, you agree to these terms with UpHai's operator.

1. The service

UpHai checks websites and APIs you choose from locations in India (Mumbai, Hyderabad and Delhi), alerts you when they fail, and hosts status pages for your customers.

Monitoring reduces the time it takes to notice a problem; it cannot prevent one. Checks run at the interval your plan allows, alerts are sent once a failure is confirmed from at least two locations, and delivery through email, Slack, Telegram or WhatsApp depends on those providers.

2. Your account

You need a valid email address to sign up. You are responsible for keeping your password safe and for everything done in your workspace, including by team members you invite.

The workspace owner controls billing and membership. Tell us at support@uphai.in straight away if you think someone has accessed your account without permission.

3. Acceptable use

Only monitor sites and services you own or are allowed to test. You must not use UpHai to:

  • send load or traffic to a site to disrupt it, or probe systems you have no right to test;
  • monitor URLs that host unlawful content, or publish such content on a status page;
  • get around plan limits, rate limits or our network protections, for example by targeting private or internal addresses;
  • resell the service or access it by automated means other than our documented API, without our written permission.

4. Plans, payment and renewal

The Free plan costs nothing. Paid plans are billed monthly in advance in Indian rupees through Razorpay, and renew automatically each month until you cancel. UpHai is not registered for GST, so no GST is charged: the price on our pricing page is the price you pay. You get an invoice for every payment.

If we register for GST, prices will then have GST added. We will tell you by email at least 30 days before GST is first charged on your renewals.

Upgrades take effect immediately. Downgrades and cancellations take effect at the end of the period you have already paid for. Refunds are covered by our Refunds & Cancellation policy.

If a renewal payment fails, Razorpay retries it and your plan stays active meanwhile; if it still can't be collected, the workspace moves to the Free plan. We may change prices with at least 30 days' notice by email; the new price applies from your next renewal after that.

5. Plan limits and downgrades

Each plan limits the number of monitors, the shortest check interval, alert channels, status pages, team members and WhatsApp messages a month. Agency includes priority support: we reply to the account's support emails within 4 business hours (Monday to Friday, 10 am to 7 pm IST); all other plans get a reply within 1 business day. When a workspace moves to a smaller plan, we bring it within the new limits: check intervals are raised to the plan minimum, monitors beyond the limit are paused (the oldest are kept), extra status pages are unpublished, and channels the plan doesn't include stop receiving alerts. Nothing is deleted.

6. Your content

You own the data you add to UpHai: monitor settings, status page text, incident updates and so on. You give us permission to store and process it only to run the service for you, including publishing what you put on a public status page.

7. Availability and changes

We work to keep UpHai available around the clock and publish our own status at status.uphai.in. We don't guarantee uninterrupted service; planned maintenance and events outside our control can cause interruptions.

We may improve or change features. If we remove something you pay for, we will tell you in advance.

8. Suspension and closing your account

You can cancel a paid plan at any time from the Billing page, and ask us to delete your account and workspace by writing to support@uphai.in.

We may suspend or close an account that breaks these terms, puts the service or other people at risk, or is used unlawfully. Where we reasonably can, we will warn you first and give you a chance to fix the problem.

9. Liability

UpHai is provided "as is". To the extent the law allows, we are not liable for indirect or consequential losses, such as lost revenue or profit caused by an outage we did not detect or an alert that was delayed or not delivered.

Our total liability for any claim relating to the service is limited to the amount you paid us in the 3 months before the claim arose. Nothing in these terms limits liability that cannot be limited under Indian law.

10. Governing law and contact

These terms are governed by the laws of India, and the courts at Pune, Maharashtra have jurisdiction. We may update these terms; if a change materially affects you, we will email the workspace owner at least 15 days before it takes effect.
